Licensing options

Overview: In this section we will cover the different licensing options available for uploading data. When you use Tranche to upload data, you must assert a CCØ License or apply a Custom License before the data can be added to the network. Any upload may be password-protected (encrypted), regardless of license type.

License Options

Public Now: Can be immediately downloaded by any user.
Public Later: Data is encrypted and passphrase protected. Encrypted data is hosted on the Tranche network, but it will remain encrypted and can only be accessed by those that you have shared the passphrase with. Using this method, data uploads can be publicly accessible only after you elect to publish the data (e.g. after a peer-reviewed publication is accepted).
Custom License: You supply a custom license for use and the data is given the licensing terms of your choice. Choose whether to make data public or restrict access (encrypted, passphrase required). The data will carry your custom licensing terms.

Note: Both the Public Now and Public Later options have the CCØ licensing terms. If you want to reserve some rights, you will want to select Custom License. You will be offered the opportunity to provide the license or make notes concerning use or contact information.

CCØ License

The CCØ License provides valuable support for interoperability for scientific data. It is the recommended choice for any project with data that will be immediately or eventually released to the public. The CCØ License enables you to indicate that a work is free of copyright and any related or neighboring rights such as moral rights, publicity or privacy rights, rights protecting against unfair competition and any rights protecting the extraction, dissemination and reuse of data. Currently, the Open Access Data protocol is the best model for open scientific data publication and sharing, and it is endorsed by the Science Commons.

In order for data to be made public with the CCØ License, you must assert that one of the following statements is true for the data being uploaded:

You waive all copyrights and related or neighboring interests that you have over a work. You can only do this if you hold the necessary rights for the work.

Or...

Assert that a work is free of copyright as a matter of fact, for example, because the work is old enough to be in the public domain, or because the work is in a class not protected by copyright such as U.S. government works. Curators and publishers of public domain material may be well placed to make such an assertion.

Do note that both the Public Now and Public Later options have the CCØ licensing choice reflected in the Tranche hash. After the data set is downloaded, a formal check can be performed to prove that the included files are indeed CCØ licensed. If at all possible, choosing Public Now is the recommended choice. It will make your data easier to find and unencrypted data downloads require much less processing time when downloading.

Custom License

You may have a specific license that you must use for whatever reason. If you choose Custom License, you can provide the license text or any necessary references.

Users are strongly encouraged not to use a Custom License instead of the CCØ License option unless it is absolutely necessary. Data uploaded with a Custom License can be publicly available or passphrase protected.
